Judicial institute has entered a new stage after joining the judiciary

For more than five decades, the Judicial Institute was remaining  a part of the exclusive power. In spite of the independence  of all the judicial institutions after 2003, this independence was not completed due to  the control of the exclusive power  presented by Ministry of Justice over the Judicial Institute. This control continued  till the issuance of the Joining Judicial Institute to Supreme Judicial Council Act No.(70) of 2017.Since then the council has  independently managed the institute which is a scientific edifice to prepare the effective judicial staff .

Since the institute joining the Supreme Judicial Council, the council has undertaken to develop it by providing the scientific environment comes in line with the scientific developments and  to develop the search  capacity of the judges  by   using  the international and local expertise and experiences in addition to theoretical  study with the practical application.

In comment to AL-Qada´a, the director general of the Judicial Institute, Nahla Hammadi, said that "  Iraqi lawmaker was supposed  to issue the joining Judicial Institute to Supreme Judicial Council Act since 2003  when the judiciary had become  independence from the exclusive power" pointing out " although the decision of joining institute to the council is late but it is right".

To know a brief history of the institute, Hammadi said that " The Judicial Institute was established in 1976 with the issuance of its Act No.(33), and its establishment marks the beginning of a new phase in the history of the judicial institution in Iraq after the appointment of judges and rulers by the competent courts. She pointed out that the Judicial Institute since its establishment was part of the Ministry of Justice because all judges and courts are part of this ministry.

Regarding to the joining  Judicial Institute to the Supreme Judicial Council, Hammadi said that the issuance of Act No. 70 of 2017 was in line with the Iraqi Constitution and the principle of independence of the judiciary as the Institute is the school that oversees the graduation of judges and prosecutors" she considered  the joining  the Institute to the judiciary is a  correct step  and the latter is the most recognized and able to make the Institute at its best"

With respect to  the role of the judiciary in the development of the Institute, Hammadi talked about a number of procedures, the most important of which is the modernization and development of all the curricula in keeping with the scientific developments and the research capabilities of its students through theoretical study and practical application in the courts. As well as the council developed  the building of the Institute and provided all the rest for students and teaching staff in line with the  supreme  academic institution which is  one of the landmarks of  the capital , Baghdad.

on his part, Professor Muwaffaq al-Abdali, one of the teachers at the Judicial Institute, said that there has been remarkable progress and positive changes in the teaching  side in terms of improving the curricula of the students, in addition to the renewal of the building dedicated to the Institute in accordance with the status of the judiciary. Al-Abdali praised the role of the judiciary, saying that there is a clear positive difference between the Judicial Institute now  and the Judicial Institute after 2003, before the Institute was joined to  the Supreme Judicial Council.

In the same context, during the dialogue of (Al-Qadha̒a) with a number of students graduates of the course (39), a student Haitham Hussein Trad said that" the President of the Supreme Judicial Council and the teaching staff and the director general of the Judicial Institute have made tireless efforts to develop all aspects of the Institute and he expressed his happiness to join  the Judicial Institute to the Supreme Judicial Council, The Institute is preparing high-level judicial figures since it is  a high school that prepares and graduates the judges .

In  respect with the future work plan , procedures and the changes have been made by the Supreme Judicial Council , the director general  of the institute explained that " the Judicial Institute conducts legal courses for all departments of the state according to their  wishes, including courses for members of military courts or for officers of the security ministries and for legal employees in the rest of the ministries" she pointed out that there is a comprehensive plan which prepared under the guidance of the President of the Supreme Judicial Council as the president of the Council of the Institute, is working and she considered it is integrated to the current and future stages.

Regarding to the cooperation with other ministries and  counterparts, Hammadi confirmed that the external and internal cooperation is one of the most important item of the plan set by  this presidency . There is a coordination with the Council of State and the Ministry of Higher education and Scientific Research to provide lecturers to the institute as well as the possibility of applying  the experience of external cooperation  of the Judicial Development Institute  in the Judicial Institute ." confirming that "there is a continuous pursuit  by the administration of the Institute to coordinate with the Ministry of Higher Education and Scientific Research to find out the requirements of the Ministry for the establishment of degrees for judges after graduating from the Judicial Institute.
