Federal Court of Cassation has revoked the decision of general commission of Bar Association in which the applicant for obtaining identity of membership of the bar is obligated to pass the proficiency exam and it specifies the age for that.
Federal Court of Cassation has revoked the decision of the board of the Bar Association to accept the request to join the bar after performance the proficiency exam that is conducted at Judicial Institute and the priority is for those aged between (22-30) years . Pointing out the Bar Act No.(173)of 1965 amended doesn't set these two conditions ,official spokesman of the Supreme Judicial Council, judge Abdul Sattar Berqdar said.
The decision of Federal Court of Cassation stipulates that the terms of reference of the General Commission of the Board of the Bar don't entitle it to obligate the applicant to perform or pass the proficiency exam or don't authorize it to add a new condition for membership only through a legislation by the legislative authority.
it is worth mentioning that Iraqi bar association, according to decision of the general commission ,last year determined the conditions of membership of the association by passing s the proficiency exam and the priority is for those aged between 22-30 years. Many groups of applicant for membership had tested at halls of Judicial Institute .
