During the meeting of the supervisor of the media center of the Supreme Judicial Council, Judge Abdel Sattar Al Bairaqdar with the President of the Council, Judge Dr. Faiq Zidan, to peruse the details of the visit of the Foreign Minister of the Islamic Republic of Iran, Muhammad Javad Zarif, to the Supreme Judicial Council on July 19, 2020, the President of the Council explained that Mr. Zarif visited Council to review the procedures of the Iraqi judiciary on the investigation of the airport accident, which led to the martyrdom of a number of Iraqi and Iranian citizens.
This comes after the issuance of the report of the United Nations Special Rapporteur on extrajudicial , summary and arbitrary executions on July 6, investigator Agnés Callamard, in which she stated " The killing of al-Muhandis and Suleimani is illegal and that this crime represents a violation of international law " as she put it.
The President of the Council clarified to the visiting delegation that the Iraqi judiciary addressed this incident as a criminal crime that is being investigated according to the investigation procedures according to the Iraqi Criminal Procedure Code, especially as one of the martyrs, and by that we mean the martyr, al-Muhandis who was occupying an official position in the Iraqi state as deputy head of the Popular Mobilization Authority that is one of the official state institutions, in addition to being a former member of Parliament. The President of the Council added that since the first hours of this crime, a number of investigative measures have been taken , as the rules of jurisdiction stipulated in the laws of all countries of the world, including the Iraqi Penal Code, provide for the validity of the national law and the jurisdiction of the national judiciary for all crimes committed inside Iraq or in the airspace of Iraqi territory or in regional waters, regardless of the type of that crime, the nationality of the perpetrator or of the victim.
The President of the Council also indicated that he discussed with the visiting delegation the suggestion submitted by the legal gentlemen accompanying Mr. Zarif who are charged with following up this file regarding the possibility of submitting a complaint about that crime to the competent international bodies in coordination between the competent authorities in the two countries at the judicial and governmental level and the two sides agreed to continue discussions between judicial and governmental representatives of the two countries to reach an appropriate mechanism in this regard and complete the discussions of representatives of the public prosecution in both countries upon this file, which was already held in the first round in Tehran several months ago, and it is hoped to complete them in the next days in Baghdad.
The President of the Supreme Judicial Council also indicated that he had previously discussed this issue with the Chief of Justice of the Islamic Republic of Iran, Mr. Raisi, during a telephone conversation in which the two sides exchanged judicial views regarding these procedures.
