The Media Center of the Supreme Judicial Council has made clear that the judiciary deal with any case filed before the courts in accordance with evidence that stipulated in the law and there is a difference between the procedures of the primary investigation and  next measures. An arrest warrant may issue against a person upon information submitted by the security investigation bodies of the executive authority after that the judiciary in cooperation with security bodies investigates an offense with which a person was charged. If the evidence is sufficient to refer him to the trial court, a judge makes the decision . Otherwise, the investigation is closed and the accused is released.

In the case of murder of the activist Ehab al-Wazni, upon request for clarification from the judge specialized in the investigation , it has been clear that Qassim Muslah who was charged with murder of the activist Ehab al-Wazni but there is no evidence was presented against him when he appeared before the judges and his statements were recorded as well as he proved according to his passport that he was outside Iraq when the al-Wazni was killed. In addition, he denied commission or participation in this offense. The investigation court did not find evidence proved his involvement directly or indirectly so that he was released after he had been arrested for 12 days. An exception effort was made to find a piece of evidence related to this crime but the investigation bodies were not able to present any evidence.  particularly , when al-Wanzi 's family were written down their statements , they did not submit a piece of evidence in accordance with the law. Noting that the offense of murder of the activist al-Wazni is a terrorist crime that is punishable by death.
