Chief of Karbala Appeal: The convict becomes in the custody of the reform departments of the Ministry of Justice after the competent courts issue the judgment

The Chief of Karbala Federal Appeal Court, Judge Rahim Numan Hashem, confirmed that the convict becomes in the custody of the Reform Department of the Ministry of Justice after the verdict is issued, indicating that all Iraqis are equal before the law without any discrimination.

After the verdict is issued ,the convicted becomes in the custody of the management of reform department to implement the judgments are issued by the courts, Hashem said during a workshop organized by the Presidency of Appeal on defining the competencies of the judiciary and the role of its courts in conducting investigations and trials in order to spread a legal culture. He added the right to litigation is guaranteed to everyone and every individual has the right to be treated fairly in judicial and administrative procedures. Noting that all hearing  sessions are public unless the court decides to make them secret for reasons specified in the text of the law.

 He explained there is no crime or punishment without a text, and the right of defense is sacred and guaranteed at all stages of the investigation and trial, in addition to that the accused is innocent until proven guilty in a fair legal trial. The court assigns a lawyer to defend the accused of a felony or misdemeanor if he does not have a lawyer. He defends him at the expense of the state. He stressed the documents of the accused during the preliminary investigation are presented to the competent judge within a period not exceeding (24) hours after the accused is arrested, which is one of the legal guarantees for the accused during the investigation stage.
